These Terms of Service (“Terms”) govern your purchase, access to, and participation in programs, coaching, educational materials, digital content, consultations, and related services offered under the Guided Intelligence brand (“Guided Intelligence,” “we,” “us,” or “our”). By purchasing, enrolling in, accessing, or using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. You are responsible for determining whether our programs and services are appropriate for your individual circumstances.
2. Nature of the Services
Guided Intelligence provides educational, coaching, personal-development, and relationship-oriented programs intended to help participants examine patterns, make informed choices, develop new skills, and pursue personal goals. Our services are collaborative. Results depend substantially on the participant's engagement, honesty, effort, choices, circumstances, and implementation. Guided Intelligence does not provide psychotherapy, medical care, psychiatric treatment, legal advice, financial advice, or professional matchmaking services unless expressly stated otherwise. Participation does not create a therapist-patient, physician-patient, attorney-client, fiduciary, or similar professional relationship.
3. No Guarantee of a Particular Relationship Outcome
Guided Intelligence cannot and does not guarantee that you will enter into a romantic relationship; remain in a particular relationship; marry or become engaged; cause another person to behave differently; obtain a particular response from another person; or achieve any other outcome that depends materially upon the independent choices or actions of third parties. Any guarantee offered by Guided Intelligence relates to your experience of and satisfaction with the applicable Guided Intelligence program, subject to the requirements below.
4. The Guided Intelligence Guarantee
We want participants who genuinely engage with the program to feel that the experience delivered meaningful value. Accordingly, when a Guided Intelligence offer expressly includes the Guided Intelligence Guarantee, an eligible participant who completes the applicable program requirements in good faith and is nevertheless genuinely dissatisfied may request that the applicable program fee be waived. If the fee has already been paid, an approved claim will result in a refund of the covered program fee. If an eligible balance remains unpaid, that covered balance will be waived. A. Good-Faith Participation Requirement To qualify, you must substantially complete the participation requirements identified for the applicable program. These may include: attending required coaching or program sessions, or completing an authorized make-up or recording where offered; completing designated lessons, exercises, worksheets, assessments, or other core program work; honestly and meaningfully engaging with the exercises rather than submitting nominal or intentionally incomplete responses merely to establish technical completion; making a reasonable, good-faith effort to implement the principal strategies, practices, or action steps taught in the program; providing accurate information necessary for coaching or program participation; using reasonable opportunities to ask questions, seek clarification, or obtain available support when you encounter difficulty; and completing the program within the applicable participation period unless Guided Intelligence agrees otherwise in writing. Guided Intelligence may verify completion using reasonable program records such as attendance records, completed exercises, submitted materials, platform activity, coaching records, or participant communications. B. What “Good Faith” Does Not Mean Good-faith participation does not require you to agree with every recommendation; follow advice you reasonably believe would be unsafe or inappropriate; obtain a particular romantic outcome; remain in an unhealthy relationship; disclose information you are uncomfortable disclosing; or pretend to be satisfied when you are not. The requirement exists to distinguish a genuine participant from someone who materially avoids the program work and then seeks free services. C. Guarantee Request A Guarantee request must be submitted within 7 calendar days after completion of the applicable program to: malcolm.k.nair@gmail.com. The request should state that you are invoking the Guided Intelligence Guarantee and briefly identify the program completed; the areas in which the program did not meet your expectations; and confirmation that you substantially completed the applicable participation requirements. We may request reasonable information necessary to verify participation. D. Guarantee Exclusions The Guarantee may be denied when records reasonably demonstrate substantial failure to complete required program activities; repeated nonattendance without completing available make-up requirements; deliberate refusal to participate in core program work; material misrepresentation regarding program participation; fraudulent conduct; misuse of the Guarantee to obtain services without intending to participate; substantially incomplete participation at the time the claim is made; or a prior refund, fee waiver, chargeback, or Guarantee claim covering the same services. A Guarantee claim will not be denied merely because Guided Intelligence believes the participant “should have been satisfied.” The relevant questions are whether the participant substantially completed the requirements in good faith and whether the participant genuinely remains dissatisfied. E. Remedy For a valid Guarantee claim, the remedy is limited to the fee specifically covered by the applicable Guarantee. Unless otherwise stated in the offer, the Guarantee does not cover third-party expenses, financing charges imposed by unrelated providers, travel costs, equipment, outside services, or other incidental expenses.
5. Fees and Payment
You agree to pay the fees disclosed at the time of purchase. If a payment plan is offered, you remain responsible for scheduled payments unless the fee is properly waived under the Guided Intelligence Guarantee; Guided Intelligence agrees otherwise in writing; or applicable law provides otherwise. You are responsible for keeping payment information current.
6. Refunds and Cancellations
Except for the Guided Intelligence Guarantee, any refund or cancellation rights will be those stated in the particular offer at the time of enrollment. Nothing in these Terms eliminates any non-waivable consumer right provided by applicable law.
7. Chargebacks and Payment Disputes
If you believe a charge is incorrect, we ask that you contact us first at malcolm.k.nair@gmail.com so we have an opportunity to investigate and resolve the issue. Nothing in these Terms prevents you from exercising lawful rights available through your payment provider. Knowingly submitting false information in connection with a refund request, payment dispute, or chargeback may constitute a material breach of these Terms.
8. Participant Conduct
Participants must interact respectfully with coaches, staff, and other participants. We may suspend or terminate participation for conduct including harassment; threats; abusive behavior; discrimination; deliberate disruption; misuse of confidential information; impersonation; fraudulent activity; or unlawful conduct. Where reasonably appropriate, we will attempt to address problems before terminating access.
9. Intellectual Property
Unless expressly stated otherwise, program materials, worksheets, videos, presentations, exercises, frameworks, recordings, graphics, text, and other Guided Intelligence content are owned by or licensed to Guided Intelligence. Enrollment gives you a limited, personal, nonexclusive, nontransferable license to use the materials for your own personal purposes. You may not reproduce, distribute, sell, license, publish, publicly display, teach from, or commercially exploit Guided Intelligence materials without written permission.
10. Confidentiality and Other Participants
You may receive personal information from or about other program participants. You agree not to disclose another participant's private information, stories, recordings, communications, or identifying details without that person's permission. Guided Intelligence cannot guarantee that another participant will comply with confidentiality expectations, so participants should use reasonable judgment when sharing sensitive information in group settings.
11. Recordings
If sessions may be recorded, participants will be informed as appropriate. Recordings will be handled in accordance with our Privacy Policy and applicable consent requirements.
12. Testimonials and Reviews
Guided Intelligence will not require you to provide a positive review as a condition of receiving the Guarantee. If you voluntarily provide a testimonial and separately authorize us to use it, we may use it according to the permission granted. You remain free to express your honest opinion about our services.
13. Personal Responsibility
You retain responsibility for your own decisions, actions, relationships, communications, boundaries, safety, and wellbeing. Guided Intelligence may provide tools, perspectives, exercises, or suggestions, but you decide whether and how to use them.
14. Third-Party Services
We may use third-party platforms for payment processing, scheduling, video meetings, communications, course delivery, customer relationship management, or related functions. Those providers may have their own terms and privacy practices.
15. Disclaimer
Except for an expressly stated Guided Intelligence Guarantee, services and materials are provided on an “as available” basis to the extent permitted by law. We do not promise any specific personal, emotional, relational, financial, or other outcome.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Guided Intelligence and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from participation in or use of the services. To the fullest extent permitted by law, our aggregate liability arising from the applicable service will not exceed the amount actually paid by you for that service. These limitations do not apply where applicable law prohibits such limitation.
17. Changes to Services or Terms
We may update these Terms from time to time. Material changes will apply prospectively and will be identified by an updated Effective Date. Terms applicable to an existing Guarantee claim will not be retroactively changed merely to defeat an otherwise valid claim.
18. Governing Law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise.
